dc.description.abstractBu yüksek lisans tezinde, hâkim durumun yıkıcı fiyat uygulaması suretiyle kötüye kullanılması konusu incelenmiştir. Yıkıcı fiyat kavramı, Türk uygulamasına yeni bir konu olsa da ABD ve AB uygulamasında yıllardır tartışıla gelen bir husustur. Bu sebeple, yıkıcı fiyat konusunda sağlıklı bir analiz yapılabilmesi amacıyla ABD ve AB yaklaşım ve içtihatları detaylı bir şekilde değerlendirilmiştir. Bu bağlamda Chicago Okulu'nu etkisindeki klasik görüş ile Oyun Teorisi etrafında şekillenen modern görüş hakkında bilgiler verilerek genel bir karşılaştırma yapılmıştır. Öte yandan Türk rekabet hukuku mevzuatı ve uygulaması hakkında da detaylı açıklamalara yer verilmiştir. Bu kapsamda mahkemelerin ve idari kurulların, yıkıcı fiyat konusunda vermiş oldukları kararlardan faydalanılmıştır. Ayrıca konu, yıkıcı fiyat uygulaması dışında hakim durum ve uygulanacak yaptırımlar yönlerinden de ele alınmıştır. Tezde detaylı bir hakim durum incelemesinin yapılmış olmasının sebebi, yıkıcı fiyat uygulamasının hakim durumda olmayan bir teşebbüs tarafından gerçekleştirilmesi halinde, rekabetçi bir davranış olarak kabul edilmesinden kaynaklanmaktadır. Yaptırımlar konusu ise yıkıcı fiyat şeklindeki bir rekabet ihlalinin; idari, hukuki ve cezai anlamda karşılaşabileceği yaptırımların belirlenmesi amacıyla incelemeye tabi tutulmuştur.en_US
dc.description.abstractIn this master's thesis, the subject of abuse of dominance through predatory pricing practises has been examined. Although the concept of predatory price is a new subject for Turkish application, it has been discussed for a long time in USA and EU. For this reason, the US and EU approach and their case law have been evaluated in detail to make a in depth analysis on the predatory pricing practices. In this context, classical approach influenced by the Chicago School and the modern approach formed around Game Theory have been explained and a general comparison for their standings is made. After these explanations, the current legislations and application of Turkish Law related to predatory price practices is analyzed. In this regard, decisions given by the courts and the administrative bodies have been examined in a detailed way. Moreover, other than predatory pricing itself, issues of dominant position and sanctions to be applied are also discussed in the thesis. The reason for the detailed examination of dominant position is that predatory pricing practices are considered to be a competitive behavior if it is carried out by a firm which is not dominant on the marketplace. The issue of sanctions is explained to specify consequences of predtory pricing practices including administrative, judicial and criminal sanctions.en_US
