6570 sayili gayrimenkul kiralari hakkinda kanuna gore tahliye nedenleri
Ülkemizde kira sozlesmeleri BK. ve 6570 sayili GKHK. hukumlerine tabi olup bu sozlesmelerin ozellikleri ve uygulanmalari bu kanunlar cercevesinde degerlendirilmektedir. Kira sozlesmesinin konusu tasinir veya tasinmaz mallar ile bir hakkin belirli bir bedel karsiliginda kullanilmasidir. Kira sozlesmeleri adi kira ve hasilat kirasi olmak uzere iki cesittir. Adi kira sozlesmelerinin konusu kullanma hakki iken hasilat kiralarinin konusu kullanma ve semerelerden faydalanmadir. Kira sozlesmesinin gecerligi herhangi bir sekle tabi degildir. Boyle olunca kira sozlesmesi yazili yapilabilecegi gibi sozlu de yapilabilir. Her halde yazili yapilmasinin ispat acisindan daha dogru olacagi soylenmelidir. Tum bunlardan da anlasildigi uzere kira sozlesmesi taraflarin serbest iradelerinin birlesmesiyle olusan rizai bir sozlesmedir. Dolayisiyla taraflar kanuna ve kamu duzenine aykiri olmamak sartiyla bu sozlesmenin hukumlerini serbestce belirleyebilirler.Bu calismada 6570 sayili Kanunda sayilan tahliye halleri incelenmistir. Bu konudaki Yargitay kararlarindan ornekler sunularak boylece somut olaylara da deginerek calismanin guncel ihtilaflara isik tutmasi saglanmak istenmistir.Hire contract was provided both by The Obligations Act of 1926 and The 6570 numbeder ?Hire Act? of 1955. This second act has special provisions only on the immovable properties which have roof on the top and are located in the municipal areas or near ports and train stations, while the first act has general provisions of the hire contract, including any kind of property and movable things. The grounds of evacuation according to Hire Act were studied in this thesis. This act aims to give maximum legal protection to the tenants as a social policy of the legislator. Because of this reason the grounds of evacuation of the tenant are very limited and each ground has some special pre-conditions.The following are the basic grounds that conclude the evacuation of a tenant: 1. Need of the landlord, his/her spouse or children (if any of the above does not have any home or workplace within the municipal area and they need a home or workplace), 2. Written promise of evacuation given by tenant, 3. Twice right warning in a ?hire year? by the landlord, especially because of tenant?s default on the payment of hire debt, 4. Greater restoration or re-construction of the property 5. Transfer of the ownership to a third party 6. Evacuation according to the Art. 12 of the Hire Act (re-hiring with no permission of the landlord).The actual regulation is above. However there has been a draft for a newer Obligations Act in the Turkish Grand National Assembly. It has not yet been discussed by the Parliament yet. In this draft there are new regulations on this evacuation matter. First of all the provisions of the hire contract are regulated by this draft. If it is sccepted by the Parliament and come into the force in the future, the current Hire Act will not exist. The moct interesting renovation relating to the evacuation of the tenant in this draft is that, a tenant who fulfilled his/her 15th year in the same property, can easily be evacuated without any other ground, after warning in written, at least 3 months before the 15th hire year.
