Abstract

Yerindelik ilkesi 1992 yilinda imzalanan Maastricht Antlasmasi ile birlikte Avrupa Birligi'nde anayasal duzeyde duzenleme altina alinmistir. O gunden bu yana Avrupa butunlesmesi baglaminda yerindelik ilkesinin anlami ve islevi tartisilmaktadir. Bu calismanin amaci ilkenin farkli tanimlarindan yola cikarak Avrupa butunlesmesine olan katkisi ve bu surecte ilkenin onemini incelemenin yani sira Avrupa Toplulugu Adalet Divani ictihatlari isiginda yerindelik ilkesinin anlamini ve islevini ortaya koymaktir. calismanin alan acisindan onemi siyasal nitelikli yerindelik ilkesinin hukuki kaynaklar uzerinden degerlendirilmesidir.
