dc.description.abstractBu makalede antik Yunan toplumunda ve modern batı toplumlarında var olan Hukuk ve Bilim kavram ve fenomenleri Max Weber’in yorumcu sosyolojisine uygun bir biçimde ideal tipler olarak ele alınmış ve karşılaştırmalı bir bakışla incelenmiştir. Buna göre, antik Yunan’daki ‘Hukuk (Nomos)’ ve ‘Bilim-Doğa (Episteme-Physis)’ anlayışları Weberci anlamda sosyolojik ideal tipler olarak nitelendirilirken, modern zamanlardaki ‘Modern Pozitif Hukuk’ ile ‘Modern Bilim’ tarihsel ideal tipler olarak ele alınmıştır. Bu anlamda ‘Hukuk’ ve ‘Bilim’in iki ayrı toplum ve düşünce yapısındaki farklı görünümleri ve etkileşimleri gösterilmeye çalışılmıştır. Sonuç olarak, modern batı toplumlarında Hukuk ve Bilim arasındaki ilişkinin değişen niteliğine vurgu yapılmış, modern zamanlarda özellikle ‘modern bilim’in sahip olduğu neden-sonuç ilişkilerine dayalı araçsal aklın nasıl ‘modern pozitif hukuk’u etkilediği hususu eleştirel bir bakış açısı ile gösterilmeye çalışılmıştır. Her iki toplumun özellikle ‘Doğa’ya bakışlarının ‘Hukuk’a bakışlarını da temelden etkilediği hususu bu makalenin en temel iddialarından birisidir.en_US
dc.description.abstractIn this paper, I take the concepts and phenomena of 'law'and 'science' as ideal types in a Weberian sense and make a comparison between the ancient Greek and modern times in these regards. Accordingly, 'law (nomos)' and 'science (episteme and physis)' in the ancient Greek society are qualified as sociological ideal types whereas 'modern positive law' and \modern science' in the modern western societies are typified as historical ideal types in the Weberian sense. The goal is to show different features and qualities of law and science in these two specific societies, namely the ancient Greek society and modern western society. In sum, it is emphasized that the relationship between law and science took quite a different form in the modern western societies than it was in the ancient Greek one. Especially it is aimed to critically analyze how instrumental rationality of modern science based on cause-effect relationship has had a drastic impact on modern positive law. One of the most crucial claims of this article is that specific ways of dealing with 'nature' in both the ancient Greek society and modern western societies inadvertently and fundamentally affected these societies' considerations of the concept of law."en_US
