Medeni yargılama hukukunda delil sözleşmeleri
Abstract
Temel bir Anayasal hak niteliğinde olan ispat hakkının kullanılabilmesi, deliller vasıtasıyla mümkün olabildiğinden, taraflarca sunulan delillerin kapsamı ispat hakkının sağlanabilmesi bakımından son derece önemlidir. 6100 sayılı Hukuk Muhakemeleri Kanunu'nun 193. maddesinde düzenlenen delil sözleşmesi ile taraflara ispat faaliyetini gerçekleştirecekleri delilleri belirleme imkânı tanınmıştır. Bununla birlikte; ispat hakkının Anayasal temel hak niteliğinde olması, taraflara tanınan delilleri belirleme imkânının sınırlarının belirlenmesi zorunluluğu doğurmaktadır. Çalışmamızın birinci bölümünde, delil sözleşmesinin tanımı yapılarak hukuki niteliği açıklanmıştır. Bu bölümde, ayrıca, delil sözleşmesinin medeni yargılama ilkeleri ve senetle ispat kuralı bakımından değerlendirilmesi de bulunmaktadır. Çalışmamızın ikinci bölümünde, delil sözleşmesinin kurulma şekilleri, geçerlilik şartları, türleri üzerinde durulmuştur. Özellikle; delil sözleşmesinin akdedilmesiyle kesin delil yaratılıp yaratılamayacağı, delil sözleşmesinin taraflar ve hâkim üzerindeki etkisi ve delil sözleşmesinin hâkim tarafından resen gözetilip gözetilemeyeceği sorunları üzerinde durulmuştur. Çalışmamızın üçüncü bölümünde ise; delil sözleşmesi akdetme özgürlüğünün hem yargılama hukuku bakımından hem de maddi hukuk bakımından sınırları belirlenmeye çalışılmıştır. As using the right of evidence, which is a basic Constitutional right, is possible
through evidences, the scope of the evidences submitted by the parties is quite
important in order that the right of evidence can be ensured. With the provision on
evidential contracts, which was regulated by Article 193 of the Law of Civil
Procedure Numbered: 6100, the parties have been given the opportunity to
determine the evidences that they use for evidencing acts. And as the right of
evidence represents a basic Constitutional right, it makes mandatory that limits are
established for the parties while they determine the evidences.
First section of our study has defined evidential contracts and explained their legal
nature. This section further includes an evaluation of evidential contracts in terms
of adjudication principles and the rule on evidencing by deed. The second section
of our study has emphasized the procedures for establishing evidential contracts,
the conditions for their validity and their types. A special emphasis has been given
to whether conclusive evidence can be created by the execution of evidential
contracts, the impact of evidential contracts on the parties & the judge and whether
evidential contracts will be officially processed by the judge. The third section of
our study has tried to determined the freedom of executing evidential contracts in
terms of both the law of civil procedure and the substantive law.
