İnternet servis sağlayıcılarının hukuki sorumluluğu
Abstract
5651 sayılı İnternet Ortamında Yapılan Yayınların Düzenlenmesi ve Bu Yayınlar Yoluyla İşlenen Suçlarla Mücadele Edilmesi Hakkında Kanun (23.05.2007 T. ve 26530 S. RG. de yayınlanan 5651 sayılı kanun) ile yapılan düzenlemede, internet servis sağlayıcıları (İSS); erişim sağlayıcı, yer sağlayıcı, içerik sağlayıcı olarak üç ana grupta ele alınmış; internet kafeler gibi internet hizmetini topluca sunan servis sağlayıcılarına yani kanuni ifadesi ile toplu kullanım sağlayıcılarına da yer verilmiştir. Kanun'da internet servis sağlayıcılarının tanımı yapılmış, yükümlülük ve sorumluluklarına yer verilmiş, ayrıca toplu kullanım sağlayıcıları için de tanım ve yükümlülükler gösterilmiştir. Buna göre Kanun, erişim sağlayıcıyı, kullanıcılarına internet ortamına erişim olanağı sağlayan her türlü gerçek veya tüzel kişiler; yer sağlayıcıyı, hizmet ve içerikleri barındıran sistemleri sağlayan veya işleten gerçek veya tüzel kişiler; içerik sağlayıcıyı, internet ortamı üzerinden kullanıcılara sunulan her türlü bilgi veya veriyi üreten, değiştiren ve sağlayan gerçek veya tüzel kişiler ve son olarak; kişilere belli bir yerde ve belli bir süre internet ortamı kullanım olanağı sağlayanları da toplu kullanım sağlayıcıları olarak kabul etmiştir. Aynı veya benzer tanımlar, 30.11.2007 T. ve 26716 S. RG de yayınlanan ve bu Çalışmada "Uygulama Yönetmeliği" olarak anılacak olan İnternet Ortamında Yapılan Yayınların Düzenlenmesine Dair Usul ve Esaslar Hakkında Yönetmelik'te ve 01.11.2007 T. ve 26687 S. RG. de yayınlanarak yürürlüğe giren, bundan böyle "Toplu Kullanım Sağlayıcıları Yönetmeliği" olarak adlandırılacak olan İnternet Toplu Kullanım Sağlayıcıları Hakkında Yönetmelik'te de bulunmaktadır. Her ne kadar 5651 sayılı Kanun'da doğrudan bahsedilmemiş olsa da, son yıllarda ağırlığını gittikçe hissettiren ve bunun yanında hukuki sorunları da beraberinde getiren internet arama motorlarının da, tanımı, yükümlülükleri ve sorumlulukları üzerinde hukuki bir araştırma, incemele ve değerlendirme yapmak, internet ortamının bu güçlü aktörlerine ve açık artırma sitelerinin durumuna da (üçüncü kişilerin sağladığı içerikten sorumluluk bakımından) değinmek gereklilik haline gelmiştir. Çalışmanın amacı; 5651 sayılı Kanun'da yer alan internet ortamındaki aktörlerin sorumluluklarının ve yükümlülüklerinin özel hukuk açısından ele alınmasıdır. Bu çerçevede Çalışmada, konu ile ilgili temel hükümler getiren, özel düzenleme olan 5651 sayılı Kanun ve ayrıca ilgili yönetmelik hükümleri ile beraber, mevzuatımızda yer alan diğer düzenlemeleri, ilgili Yargıtay kararlarını ve iç hukuk açısından internet ortamını düzenleyen kurum ve kuruluşları da ele almak yerinde görülmüştür. Uluslararası bir yapıya sahip olan internet ortamının, sadece iç hukuk ile kontrol ve denetiminin mümkün olmadığı da dikkate alınarak, Çalışmada, karşılaştırmalı hukukta yani AB'de ve Almanya ile ABD'de konu ile ilgili öngörülen düzenlemelere de yer verilmiştir. Bu bağlamda, Çalışmada, AB üyelik sürecinde olan ülkemizin iç hukukunu etkileyen ve kaynak oluşturan 2000/31 S. AB Elektronik Ticaret Direktifi'ne önemle değinilmiştir. Açık adı, "Bilgi Toplumu Hizmetlerinin Özellikle Elektronik Ticaretin Ortak Pazardaki Bazı Yönleri Hakkında 8 Haziran 2000 T. ve 2000/31/EC S. Avrupa Parlamentosu ve Konseyi Yönergesi/Direktifi" olan düzenlemeye, bu Çalışmanın ilerleyen bölümlerinde "2000/31 sayılı AB Direktifi" olarak anılacaktır. Çalışmada; ilk olarak, internet, internet ortamı, internet ortamında yapılan yayın, internet sistemi ve elektronik ortam kavramları açıklanmış, internetin dünyada ve ülkemizdeki tarihsel gelişimine kısaca yer verilmiş ve internetin yönetimi kapsamında internet ortamında düzenleyici rol oynayan uluslararası ve ulusal kurum veya kuruluşlardan bahsedilmiştir. Bunun akabinde, Çalışma konusunu oluşturan İSS'lerin hukuki sorumluluğuna dair Türk hukukundaki pozitif düzenlemeler gösterilmiştir. Ardından ise, İSS'lerden ve internetin diğer aktörlerinden söz edilmiş, kendilerine 5651 sayılı Kanun'da yer bulan toplu kullanım sağlayıcıları üzerinde de durulmuştur. 5651 sayılı Kanun başta olmak üzere mevzuatımızda yer alan diğer düzenlemeler çerçevesinde internet servis sağlayıcılarının yükümlülük ve sorumluluklarına Çalışmamızda geniş olarak yer verilmiş; bunların kapsamı, mahiyeti, niteliği ve hukuki sonuçları üzerinde durulmuş; Çalışmamızın ana konusu olan İSS'lerin hukuki sorumluluğu karşılaştırmalı hukuk açısından da ele alınmış, yasal düzenlemeler yanında karşılaştırmalı hukukta rastlanan yargı kararları da Çalışmaya alınmıştır. Ayrıca, 2000/31 sayılı AB Direktifi düzenlemesi de detaylı olarak izah edilmiştir. Çalışmada, İSS'lerin cezai sorumlulukları üzerinde ise durulmamıştır. Ayrı bir çalışma konusu olabilecek nitelikteki bu konunun, sadece İSS'lerin hukuki sorumluluklarını etkileyen yönlerine değinilmekle yetinilmiştir. Ayrıca, Çalışmada, İSS'lerin borçlar hukuku anlamında telekomünikasyon işletmeleri (Türk Telekom A.Ş.) ve kullanıcılar ile aralarındaki sözleşmelerden kaynaklanan sorumlulukları da incelenmemiştir. Bundan başka, erişimin engellenmesi koruma tedbiri bütün yönleri ile (5651 sayılı Kanun'da bu koruma tedbirine ayrılan bütün hükümler bağlamında) ele alınmamış; İSS'lerin hukuki sorumluluğunu ilgilendirdiği kadarı ile irdelenmiştir. Son olarak, internet servis sağlayıcılarının hukuki sorumluluğu konusunda erişimin engellenmesi, koruma tedbiri dışında başvurulabilecek hukuki çareler olarak koruyucu davalar da kapsamları itibarıyla ayrı bir çalışma konusu olarak görüldüklerinden işbu Çalışmamızın konusu dışında bırakılmıştır. Fakat böyle olmakla birlikte, kişilik haklarının ve fikri hakların ihlali halinde açılabilecek koruyucu davaların hangileri olduğu da kısaca zikredilmiştir. Çalışma, hukuk uygulayıcıları için yararlı bir hukuki kaynak olması dileğiyle kaleme alınmıştır. In the regulation made with 5651 numbered Law on Regulation of Publications on the
Internet and Suppression of Crimes Committed by means of Such Publications (Law
numbered 5651, Official Gazette, May 23rd,2007 date and 26530 numbered ), the Internet
service providers (ISPs); are dealt with in three main groups as access provider, hosting
provider and content provider; and the service providers presenting internet service
collectively, which means internet public use provider with its legal expression, such as
internet cafes are included in this regulation. In the Law, the definition of Internet service
providers is made, their obligations and responsibilities are included and definition and
liabilities for internet public use providers are also indicated, as well. Accordingly, the Law
accepted the access provider as any natural or legal persons who allow users to access the
internet environment; hosting provider as any natural or legal persons who provide or operate
systems hosting services and contents; content provider as any natural or legal persons who
produce, change or provide all kinds of information or data presented to users through the
Internet environment; and finally those who provide access to use the internet environment in
a certain place and a certain time to persons as internet public use providers. The same or
similar definitions are also included in the Regulation on the Principles and Procedures
Concerning the Regulation of Publications on the Internet and in the Regulation on Internet
Public Use Provider.
It becomes necessary to make legal research, investigation and evaluation on
definition, obligations and responsibilities of internet search engines which become influential
in recent years and bring along the legal issues with it, even though it was not mentioned

directly in the Law numbered 5651, and to mention these powerful actors of internet
environment and the situation of auction sites (in terms of responsibility of the content
provided by third parties).
The aim of the study is; addressing the responsibilities and liabilities of actors in the
internet environment in the Law numbered 5651 in terms of private law. In this framework,
it is considered approppriate.to deal with Law numbered 5651 which is a private regulation
and which brings basic provisions on the subject and also with the relevant regulations, and
other regulations in our legislation, relevant decisions of the Supreme Court and institutions
and organizations regulating the internet environment in terms of domestic law in this Study.
Also, by taking into account the fact that it is not possible to control and audit the
internet environment having an international structure only with domestic law, the relevant
regulations on the issue in the USA and in the EU and Germany within this context in
comparative law are included in this study. In this study, the 2000/31 S. EU Electronic
Commerce Directive that constitutes a source and that affects the domestic law of our country
which is in the EU accession process has been strongly addressed.
In this study, firstly, the internet, internet environment, publications on the internet,
internet system and electronic media concepts have been described, the historical
development of the internet in the world and in our country has been referred briefly and
international and national institutions or organizations which plays a role in regulating internet
environment within the scope of the internet management have been mentioned. Thereafter,
the positive regulations in Turkish law on the civil liability of the ISPs constituting the subject
of this study have been viewed. Then, the ISPs and other actors of the internet have been
mentioned and it has been focused on internet public use providers stated in the Law
numbered 5651.
Within the framework of other regulations in our legislation, especially the Law
numbered 5651, the internet service providers and their obligations and responsibilities have
been handled extensively in our Study; their scope, nature, quality and legal consequences
have been focused on; the legal responsibility of ISPs which are the main subject of our study
has been discussed in terms of comparative law and judicial decisions encountered in
comparative law in addition to the legal regulations have been included in this Study.

Moreover, the 2000/31 numbered EU Directive regulation has been explained in detail. In this
study, the criminal responsibility of ISPs has not been addressed. Since this subject can be a
separate subject of study, it has been only referred to the aspects affecting the legal
responsibilities of ISPs. In addition to this, the ISPs’ telecommunication operators (Türk
Telekom A.Ş.) and their responsibilities arising from the contract between them and users, in
terms of obligations law have been studied in this study. Furthermore, access blocking
protection measures have not been addressed (within the context of all the provisions allocatedto these protection measures in the Law numbered 5651) with all aspects; rather, it was
discussed partially that concerning legal responsibility of ISPs. Finally, since the protective
lawsuits which can be applied about the civil liability of service providers as legal remedies
beyond the access blocking protection measures are seen as separate subjects of study as of
the scope, it was excluded from the subject of this study. However, in spite of that, the issue
of which protective cases that can be opened in case of violation of personal rights and
intellectual property rights has been mentioned.
This study has been written to be a helpful resource of legal qualifications for legal
practitioners.
