Article 5403 Sayılı Kanun Çerçevesinde Terekedeki Tarım Arazilerinin Devredilmesi Karşısında Muris Muvazaası(Istanbul Univ, 2020) Senol, A. Nilay; Kazmacı, Özge UzunThe Law on Protection of Soil and Land Use, numbered 5403, aims to protect the unity of agricultural lands, and to prevent the division of the soil with inheritance. This law stipulates first, the possibility regarding the giving over of the agricultural land in succession to one or more heirs, to a family partnership, to a limited liability company or to a third person with the consensus of the heirs and second, in case of disagreement, the judge shall decide whether to leave the agricultural land to a competent heir or to sell the land. Furthermore, according to this law, the competent heir to whom the agricultural land will be left can be determined by means of testamentary disposition. It is possible and also valid within the legal constraints that the testator can also transfer the agricultural land to one of the heirs while he is alive. It is arguable whether this transaction can be considered as the testator’s simulation or not, if this transaction has also been made with a simulated transaction. Some principles are set out by the Supreme Court in terms of the simulation of the testator, and although these principles and decisions are criticized by the doctrine, such cases are held by these principles. The purpose and the regulations of the Law numbered 5403 shall be taken into consideration in determining testator’s simulationArticle Ab Hukuk Düzeni ve Emca’da Anonim Ortaklıklarda Çoğunluğun Kötüye Kullanımının Etkilerinin Azaltılması: İzole ve Halka Kapalı Türk Anonim Ortaklıklarında Azınlığın Korunması İçin Esinlenmek Mümkün Mü?(Istanbul Univ, Fac Law, 2024) Görmez, OnurAB mevzuatında, çoğunluğun kötüye kullanılması hususunu düzenleyen genel bir hüküm bulunmamaktadır. Üye devletlerde ise konuya dair iki ayrı yaklaşım bulunmaktadır. Bunlardan Fransa’da kabul gören çift eşikli yaklaşım olarak adlandırılabilecek ilki hem azınlığın hem de ortaklığın çıkarının zedelenmesini aramaktadır. Almanya ve İskandinav ülkeleri gibi bazı ülkelerde kabul gören tek aşamalı yaklaşım olarak adlandırılabilecek diğer yaklaşımda yalnızca azınlığın çıkarının zedelenmesi yeterli görülmektedir. AB düzenlemeleri de dikkate alınarak akademisyenler tarafından hazırlanan bir model yasa çalışması olan EMCA’da da kendisine yer bulan ikinci yaklaşım azınlık pay sahipleri için daha iyi bir koruma sunmaktadır; özellikle izole ve halka kapalı anonim ortaklıkların azınlık pay sahipleri yönünden. Adalet Divanı’nın Audiolux kararıyla da ortaya konduğu üzere AB Hukuku’nda pay sahipleri yönünden uygulama alanı bulacak genel geçer bir eşit işlem ilkesi söz konusu değildir. EMCA’da olduğuna benzer şekilde TTK m.357’de ise eşit şartlardaki pay sahiplerinin eşit işleme tabi tutulması gerekliliğini öngören hüküm uyarınca, Türk hukukunda da ortaklıkta çoğunluğun kötüye kullanılmasının tartışma konusu olduğu hallerde, kötüye kullanmayı tespit için tek eşikli yaklaşım yeterli olmalıdır. İzole ve halka açık olmayan anonim ortaklıklarda azınlık pay sahiplerinin etkin bir şekilde korunması için uygulanabilecek yöntemler bakımından ise, sınır aşan tür değiştirme, birleşme ve bölünmeler yönünden 2017/1132 sayılı Yönerge seviyesinde de öngörülen azınlığa ortaklıktan çıkma hakkı tanıyan bir düzenlemenin getirilmesi yerinde olacaktır. Haklı nedenle feshi düzenleyen TTK m.531’in değiştirilmesi suretiyle azınlık pay sahiplerine, paylarını satarak ortaklıktan çıkmayı doğrudan mahkemeden talep edebilecekleri bir düzenleme getirilmesi de düşünülmelidir. EMCA Bölüm 11.35 ve Bölüm 11.37’deki pay sahiplerinin paylarını satarak ortaklıktan çıkması ile payların satın alınmasını talep etme veya paylarını satmaya zorlama hususlarında öngörülen hükümlerden TTK için de esinlenilebilir.Article Citation - WoS: 12Citation - Scopus: 15Accurate Refinement of Docked Protein Complexes Using Evolutionary Information and Deep Learning(Imperıal College Press, 2016) Akbal-Delibas, Bahar; Farhoodi, Roshanak; Pomplun, Marc; Haspel, NuritOne of the major challenges for protein docking methods is to accurately discriminate native-like structures from false positives. Docking methods are often inaccurate and the results have to be refined and re-ranked to obtain native-like complexes and remove outliers. In a previous work we introduced AccuRefiner a machine learning based tool for refining protein-protein complexes. Given a docked complex the refinement tool produces a small set of refined versions of the input complex with lower root-mean-square-deviation (RMSD) of atomic positions with respect to the native structure. The method employs a unique ranking tool that accurately predicts the RMSD of docked complexes with respect to the native structure. In this work we use a deep learning network with a similar set of features and five layers. We show that a properly trained deep learning network can accurately predict the RMSD of a docked complex with 1.40 angstrom error margin on average by approximating the complex relationship between a wide set of scoring function terms and the RMSD of a docked structure. The network was trained on 35000 unbound docking complexes generated by RosettaDock. We tested our method on 25 different putative docked complexes produced also by RosettaDock for five proteins that were not included in the training data. Laceration of an aortic valve cusp was treated successfully with urgent aortic valve replacement. A concomitant orthopedic injury was treated electively 15 days after cardiac surgery. Acute aortic valve rupture is a very rare complication of blunt chest trauma. There were 4 women (17%) and 20 men (83%). Mean age was 61.7 ± 2.02 years. Gastrointestinal bleeding (33.3%) mesenteric ischemia (20.8%) pancreatitis (20.8%) hepatic dysfunction (16.7%) and cholecystitis (16.7%) were the most common complications. Mortality was 41.7% (10 patients). During the same period mortality in the patients who did not develop gastrointestinal complications was 1.89% (p < 0.0001). Emergency basis reoperation combined operations peripheral vascular disease diabetes mellitus chronic lung disease and impaired left ventricle function were found to be risk factors for the development of postoperative gastrointestinal complications.Article Citation - Scopus: 12Affective Modulation of Working Memory Maintenance: the Role of Positive and Negative Emotions(University of Economics and Human Sciences in Warsaw, 2021) Gokce,A.; Zinchenko,A.; Annac,E.; Conci,M.; Geyer,T.The present study investigated the impact of task-irrelevant emotional images on the retention of information in spatial working memory (WM). After a short retention interval, a probe item appeared and participants were required to indicate whether the probe position matched one of the previously occupied square positions. During the retention interval, task-irrelevant negative, positive, or neutral emotional pictures were presented. The results revealed a dissociation between negative and positive affect on the participants’ ability to hold spatial locations in WM. While negative affective pictures reduced WM capacity, positive pictures increased WM capacity relative to the neutral images. Moreover, the specific valence and arousal of a given emotional picture was also related to WM performance: While higher valence enhanced WM capacity, higher levels of arousal in turn reduced WM capacity. Together, our findings suggest that emotions up- or down-regulate attention to items in WM and thus modulate the short-term storage of visual information in memory. © 2021 University of Finance and Management in Warsaw. The auction mechanism supply and demand determine the equilibrium at each hour. In this environment firms aim to maximize their revenues by carefully determining their bids. This requires the development of effective computational methods that help them estimate their competitors' behaviors under incomplete information. In this article an agent-based method that uses particle swarm optimization is described to simulate the behavior of market participants. Particle swarm optimization is used in the bidding process and an agent-based model is applied to find a Nash equilibrium. Different stopping conditions are used to determine the equilibrium. The study analyzes the reciprocal effects of robotization on different generations and presents the analysis of the effects of age groups on the robotization of countries. Based on an instrumentalization of the System GMM estimation method of a dynamic panel dataset of 28 selected countries over 2004 and 2016, the results show that the number of young workers is affected negatively from robotization, whereas there is a positive impact of robot adoption on old workers. Evidence further suggests that robotization is triggered by the density of young workers in the workforce of the country.Article Citation - WoS: 1An analysis of social media content shared by right-wing extremist groups in the United States, the Great Britain and Australia(Istanbul Univ, Fac Communication, 2023) Masalha, Oday; Bas, OzenThe extreme right movements have increasingly appeared on social media, especially on Twitter and Facebook, coinciding with the 2019 New Zealand attack, the 2019 El Paso incident, and Britain's exit from the European Union in 2020. This study examines the content and the form of extreme right-wing activities on Facebook and Twitter to promote their ideologies. A qualitative content analysis was conducted on posts shared by extreme-right groups on public Facebook and Twitter accounts in Great Britain, the United States and Australia. The sample spans from March 15, 2019 to February 5, 2020. The posts were coded according to a coding instrument developed based on the existing literature spreading extremist ideologies on social media. The coding instrument consisted of categories and subcategories such as 'the protection of western values', 'anti-LGBT activism', 'anti-feminism', 'anti-Islam', 'anti-immigrant sentiments', 'fostering the white race', and 'anti-elitist populism'. Findings suggest that the most prevalent extremist ideologies on Facebook and Twitter posts were 'anti-elitist populism' and 'the protection of western values'. Also, extremist groups heavily shared posts that combined texts and images to spread their ideologies on social media.Article Aortanın İleri Derecede Aterosklerozunda Koroner Arter Cerrahisi(1999) Akpınar, Belhhan; Güden, Mustafa; Polat, Bülent; Sağbaş, Ertan; Sanisoğlu, İlhan; Sönmez, Bingür; Demiroğlu, CemşidAçık kalp cerrahisinde tekniklerin ilerlemesine rağmen nörolojik komplikasyonların görülme sıklığı azalmamıştır ve inme (stroke) morbidite ve mortaliteyi önemli ölçüde artırmaktadır. Bu yazıda çıkan aortada ileri derecede kalsifikasyon bulunan vakalarda hipotermik fibrilasyon tekniği kullanılarak aortaya dokunulmadan ve kross klemp konulmadan yapılan koroner by-pass ameliyatları anlatıldı. 2 yıl içinde aortada ileri derecede kalsifikasyon bulunan 23 olguda bu teknik kullanıldı. Yaş ortalaması 65 + 3 yıl idi. Kardiopulmoner bypass için femoral arter ve sağ atrium kullanıldı. Tüm hastalar 26-28 ºC'de ventriküler fibrilasyon ile ameliyat edildi ve internal torasik arterler ve gastroepiploik arter ve bu greftlerin kombinasyonu kullanıldı. Aortaya klemp uygulanmadı ve proksimal anastomoz yapılmadı. 30 günlük ölüm oranı 0 idi. Hiçbir olguda nörolojik komplikasyon, alt ekstremite iskemisi ve hemodinamik problem gözlenmedi. Sadece 1 olgu kanama nedeniyle tekrar ameliyata alındı ve eksik revaskülarizasyon yapılan 1 vakada peroperatif miyokard enfarktüsü görüldü, fakat hemodinamik olarak bir problem olmadı. Çalışma A.B.D.’de 2003-2015 yılları arasında tamamlanan 6,888 birleşme ve satınalmaya dayanmakta ve panel veri regresyonları kullanmaktadır. Sonuçlar alıcıların 73%’ünün maliyetlerinin asimetrik davranış sergilediğini göstermektedir. Birleşme duyurusunun ardından maliyet yapışkanlığı ile alıcıların olağandışı getirileri arasında anlamlı ve negatif bir ilişki olduğu saptanmıştır. Piyasadaki rekabet alıcıların getirilerini olumlu etkiler, ancak yapışkan maliyetlerin alıcıların olağandışı getirileri üzerindeki olumsuz etkisini daha da artırır. Ayrıca alıcıların temerrüt riskinin olağandışı getiriler üzerinde anlamlı ve negatif yönde etkisi vardır. Bununla birlikte, temerrüt riskinin getiriler üzerindeki olumsuz etkisi yapışkan olmayan maliyet yapısı olan alıcılar için daha kuvvetlidir. Alıcıların riski rekabetin getiriler üzerindeki pozitif etkisini azaltmaktadır. Bir yıllık olay penceresinden incelendiğinde, yapışkan maliyet yapısına sahip alıcıların yapışkan olmayan maliyet yapısına sahip alıcılara göre daha az olağandışı getirilere sahip olduğu gözlemlenmiştir. Bu çalışma 2003-2015 yılları arasında gerçekleşen birleşmelerde rol alan alıcıların asimetrik maliyet davranışlarını ortaya çıkararak ve alıcı firmaların daha düşük olağandışı getiri elde etmelerine alternatif bir açıklama getirerek literatüre katkıda bulunmuştur.Article An Assessment of the Current State of Turkish Law in Light of the Reforms Introduced by Directive 2024/2853 on Product Liability(Istanbul Univ, Fac Law, 2025) Caliskan, Alican; Yildirim, Kaan CanThis study examines the significant reforms introduced by the European Union's New Product Liability Directive (2024/2853) and evaluates the current status of Turkish product liability law in light of these changes. The former Directive 85/374, in force for nearly 40 years, had become outdated due to rapid technological advancements and digitalization. The new Directive responds to these developments by explicitly including software and artificial intelligence within the definition of "product," introducing presumptions that ease the burden of proof for injured parties, expanding liability to cover not only manufacturers but also broader economic operators, and redefining the moment of liability to include, under certain circumstances, the lifecycle of the product-not just its release date. In this way, it is intended to make it easier for those injured to access broader protection in a more convenient way. In Turkish law, although Law No. 7223 on Product Safety and Technical Regulations, enacted in 2020, officially introduced strict liability for producers, it diverges significantly from the new Directive in key areas. The definition of product excludes intangible digital products like software, no presumptions are provided in favor of injured parties, and the concept of "nonconformity" is framed narrowly around technical regulatory compliance rather than user safety expectations. The article concludes that Turkey's product liability regime, although relatively recent, is already outdated in the face of modern challenges and EU standards. For meaningful alignment and effective user protection in the digital age, the Turkish framework must be revised to better reflect the core objectives and modern scope of the new EU Directive.Article Citation - WoS: 2Asymmetric Cost Behavior and Acquirer Returns: Evidence From U.s. Mergers(Ege Univ, 2019) Uğurlu, Mine; Öztürk Danışman, Gamze; Bilyay-Erdoğan, Seda; Vural-Yavaş, ÇiğdemThis paper investigates the asymmetric behavior of the selling, general and administrative (SG&A) costs of acquirers, and reveals its effects on mergers & acquisitions (M&A) performance in a one-year event window. It is based on a sample of 6888 M&As completed in the U.S. during the 2003-2015 period and employs panel data regressions. The results show that 73% of the acquirers display asymmetric cost behavior. A significant negative relation is found between cost stickiness and acquirers' abnormal returns following the merger announcement. Competition in the market for corporate control is positively related with acquirer returns but exacerbates the negative effects of cost-stickiness on abnormal returns of acquirers. The acquirers' risk of default is significantly negatively related to the abnormal returns they generate. This adverse effect of default risk on returns is stronger for acquirers with anti-sticky costs. Acquirer risk offsets the positive effects of competition on returns. Acquirers with sticky costs have lower abnormal returns than those with anti-sticky costs in a one-year window. The present study contributes to the literature by revealing the asymmetric cost behavior of acquirers involved in merger activity during the last decade, and provides evidence for an alternative explanation for the lower abnormal returns of the acquiring firms.Article Attractiveness Differentially Affects Direct Versus Indirect Face Evaluations in Two Cultures(Sage Publications Inc, 2023) Cassidy, Brittany S.; Saribay, S. Adil; Yuksel, Huseyin; Kleisner, KarelAlthough decades of research have identified facial features relating to people's evaluations of faces, specific features have largely been examined in isolation from each other. Recent work shows that considering the relative importance of these features in face evaluations is important to test theoretical assumptions of impression formation. Here, we examined how two facial features of evolutionary interest, facial attractiveness and facial-width-to-height ratio (FWHR), relate to evaluations of faces across two cultures. Because face evaluations are typically directly measured via self-reports, we also examined whether these features exert differential effects on both direct and indirect face evaluations. Evaluations of standardized photos naturally varying in facial attractiveness and FWHR were collected using the Affect Misattribution Procedure in the United States and Turkey. When their relative contributions were considered in the same model, facial attractiveness, but not FWHR, related to face evaluations across cultures. This positive attractiveness effect was stronger for direct versus indirect evaluations across cultures. These findings highlight the importance of considering the relative contributions of facial features to evaluations across cultures and suggest a culturally invariant role of attractiveness when intentionally evaluating faces.Article Batı Anadolu Grabenlerinin Gelişim Süreci İçinde Selçuk Grabeni’nin Morfotektonik Evrimi(2023) Yılmaz, Yücel; Gürer, Ömer Feyzi; Erbay, YücelKüçük Menderes Grabeni’nin batı ucunda yer alan ancak ondan sol yönlü doğrultu atımlı faylarla kesilip güneybatıya atılmış olan grabene bu çalışmada Selçuk Grabeni adı verilmiştir. Çünkü bu graben ana grabenden ileri evrelerde önemli farklılıklar geçirmiştir. Grabeni sınırlayan horstlarda metamorfik temel kayaları mostra vermektedir. Dolgusu ise Küçük Menderes Nehri’nin alüvyonundan oluşmaktadır. Selçuk Grabeni asimetrik bir grabendir. Güney kanat morfolojik nitelikleriyle belirgin ve aktif kenardır. Normal faylar bu kanatta birkaç fay basamağı halindedir. Kuzey kanat, aktif kenarı oluşturan kürek biçimli ana fayın tavan blokunda gelişmiş, antitetik faylar olarak yorumlanabilir. Grabeni az çok uzanımına verev birçok doğrultu atımlı fay kesmiştir. Genç yapısal ögeler graben ve yakın çevrenin morfolojisindeki izleriyle tanınmaktadır. Batı Anadolu’nun morfotektonik gelişim süreci içinde Selçuk Grabeni en geç gelişen grabenlerdendir. Küçük Menderes Grabeni, üzerinde yer aldığı horstun, Kuvaterner’de önce yükselip daha sonra çökmesi döneminde açılmıştır. Bu dönemde Selçuk Grabeni ana grabenin batıdaki uzanımında yer almıştır. Daha sonra özellikle sahil bölgelerinin morfotektoniğini büyük ölçüde değiştiren KKB doğrultulu sol yönlü doğrultu atımlı faylar ve bunlarla eşzamanlı fay çiftlerinin gelişmesiyle Küçük Menderes Grabeni’nden ayrılarak güneybatı yönünde ötelenmiş ve Küçük Menderes’le olan doğrudan bağlantısı kopmuştur. Geç Kuvaterner’de gelişmiş olan bu evreden sonra gelişimini bağımsız bir graben olarak sürdürmektedir.Article Citation - WoS: 1Citation - Scopus: 2A Bayesian Approach To Developing a Strategic Early Warning System for the French Milk Market(Halmstad University, 2017) Bisson, Christophe; Gürpınar, FurkanA new approach is provided in our paper for creating a strategic early warning system allowing the estimation of the future state of the milk market as scenarios. This is in line with the recent call from the EU commission for tools that help to better address such a highly volatile market. We applied different multivariate time series regression and Bayesian networks on a pre-determined map of relations between macro-economic indicators. The evaluation of our findings with root mean square error (RMSE) performance score enhances the robustness of the prediction model constructed. Furthermore possible absence of the signal is not taken into account while evaluating the spectrum sensing performance. In this study Bayesian CS is studied in detail for primary user detection. In addition to assessing the signal reconstruction performance and comparing it with the conventional basis pursuit approach and the corresponding lower bounds signal detection performance is also considered both analytically and through simulation studies. In the absence of a primary user signal the trade-off between probabilities of detection and false alarm is studied as it is equally important to determine the performance of a CS approach when there is no active primary user. To reduce the computation time and yet achieve a similar detection performance finally the effect of number of iterations is studied for various systems parameters including signal-to-noise-ratio compression ratio mean value of accumulated energy and threshold values. The presented framework in this study is important in the overall implementation of CS-based approaches for primary user detection in practical realisations such as LTE downlink OFDMA as it considers both signal reconstruction and detection.
