Fikir ve Sanat Eserleri Kanununa Göre Meslek Birlikleri

Abstract

Eser sahiplerinin haklarini bireysel olarak uygulanabilir kilabilmeleri zor veya imkansiz oldugundan fikri mulkiyet bu yonuyle bir cok sekilde kullanilabilir. Eser kullanim ucretlerinin her kullanim icin cuz'i miktarda oldugu durumda eser sahipleri diger hak sahipleri ile ekonomi yaparak telif ucretleri konusunda isbirligine gitmedikce telif ucretlerini toplamakta ve hakkini ihlal edenleri yasaklamakta bir yarar gormeyecektir. Bu asamada sorun meslek birliklerinin olusturulmasiyla cozumlenmektedir. Bu tez meslek birliklerinin detayli bir sekilde incelenmesiyle olusmus olup uygulama sahasindan orneklerle de enginlestirilmistir.

Problems at this stage, creation of collecting societies are resolved. This thesis, in a detailed examination of the collecting societies was formed, and also enriched with examples from the application area.
