Boşanma Sonrasında Ortak Çocuğun Hukuki Durumu

Abstract

Boşanma, sadece eşler arasındaki evlilik birliğinin sona ermesi sonucunu doğurmamaktadır. Boşanma aynı zamanda, çocuklar açısından da birtakım ciddi hukuki sonuçların doğmasına neden olmaktadır. Boşanma kararının ardından çocuğun velayetinin hangi ebeveyne verileceği, kişisel ilişkiye ilişkin düzenlemeler, çocuğun ihtiyaçları için iştirak nafakası takdiri vb. bizzat çocuğu ilgilendiren konular mahkeme tarafından değerlendirilir. Bu süreçte hâkim, her koşulda çocuğun üstün yararını gözeterek karar vermelidir. Çalışmamızda, boşanmanın çocuklar bakımından doğurmuş olduğu temel hukuki sonuçları Türk Medeni Kanunu ve Yargıtay kararları çerçevesinde ele almakta ve uygulamada karşılaşılan ve sorunlu olduğunu düşündüğümüz konulara dikkat çekmeyi amaçlamaktadır.

Divorce does not only result in the termination of the marital relationship between spouses; it also brings about important legal consequences for children. After a divorce, the court evaluates several issues directly concerning the child, such as which parent will be granted custody, how visitation rights will be arranged, and how child support will be determined. Throughout this process, the judge must always consider the best interests of the child. This study examines the main legal consequences of divorce in relation to children within the framework of the Turkish Civil Code and decisions of the Court of Cassation, aiming to draw attention to problematic areas encountered in practice.
