Paket Tur Sözleşmeleri

Abstract

Tezin konusu Tuketicinin Korunmasi Hakkinda Kanun’un 51. maddesinde ozel olarak duzenlenen paket tur sozlesmeleridir. Paket tur sozlesmelerinin var olabilmesi icin ulastirma ve konaklama hizmetlerinin birlikte sunulmasi veya bunlarin en az biri ile ve bu hizmetlerden bagimsiz olan baska bir turizm hizmetlerinin bir araya gelmesi gerekmektedir ayrica sozlesme suresinin en az yirmi dort saati gecmesi ya da gecelik konaklamayi icermesi gerekmektedir. Paket Tur Sozlesmeleri Yonetmeligi de goz onune alinarak paket tur sozlesmelerinde katilimcinin (tuketici) ve paket tur duzenleyenin haklari ve yukumluluklerinin neler oldugu sozlesmenin ifasinin oncesinde ya da ifasi sirasinda katilimcinin (tuketicinin) sahip olabilecegi haklarin neler oldugu ve nihayetinde paket tur sozlesmesinin sona erme halleri incelenmistir.

The subject of this thesis is package tour contracts, which is specially regulated in Article 51 of the Consumer Protection Law. In this respect, the package tour contracts have to contain transportation and accommodation services together, or at least one of these services together with other tourism services that are independent from these services, and these contracts also have to include at least twenty four hours of staying or overnight accommodation. Considering the Regulation on Package Tour Contracts, the rights and obligations of the participant (consumer) and organizer of the package tour, the rights that the participant (consumer) may have before or during the fulfillment of the contract, and lastly the ending cases of the respective contract are examined within the views in the doctrine.
