Sağlık Çalışanlarının Hakları ve Hak Arama Yolları

Abstract

Bu tez çalışmasının amacı, sağlık çalışanlarının haklarını tespit edip sınıflandırmak ve haklarının ihlal edilmesi halinde, hangi vasıtaları kullanarak haklarını arayabileceklerini ve bu hak arama sürecini ortaya koymaktır. Zira, sağlık çalışanlarının hakları, kanun koyucu tarafından, hasta hakları gibi sistematik bir şekilde ele alınmadığı için ilgili mevzuat, dağınık şekilde bulunmaktadır. Bu sebeple, sağlık çalışanlarının haklarını tespit etmek bakımından, tek tek sağlık mevzuatı; meslek etik ilke ve kuralları taranmıştır. Bu kapsamda, öncelikle sağlık çalışanı kavramı açıklanarak, sınıflandırılmaya tabi tutulmuş ve hak kavramı kısaca açıklandıktan sonra, bu hakların neler olduğu konusuna geçilmiştir. Haklar ele alınırken, meslek hukuku açısından haklar ve disiplin hukuku açısından haklar olmak üzere ikili ayrıma gidilmiştir. Bu tez çalışması vesilesiyle, sağlık çalışanlarının da hakları olduğu hatırlatılmak istenmiştir. Aralarındaki ilişkinin doğası, gereği zayıf konumda bulunan hastaların haklarını korumaya çalışırken, ilişkinin diğer tarafındaki sağlık çalışanlarının haklarına gerekli hassasiyeti göstermememiz halinde; sağlık çalışanlarının mesleki memnuniyetinin sağlanamayacağına işaret edilmek istenmiştir. Zira, böyle bir tabloda; ne hasta hakları yeterince korunarak hasta memnuniyeti arttırılabilecek ne de ideal bir sağlık politikası yürütülebilecektir.

The aim of this thesis is to determine and classify the rights of health care professionals' and to indicate legal remedies and the process, in case of violation of their rights. Since the rights of health care professionals are not systematically handled by the legislator, such as patient rights, the relevant legislation is in a dispersed manner. Therefore, in order to determine the rights of health care professionals, individual health legislation, professional ethical principles and rules have been scanned. While classifying these rights, the classification forms included in various books and theses were taken into consideration. In this context, first of all, the concept of health care professionals has been classified and after the concept of right has been briefly explained, the subject of what these rights are also explained. While the rights were taken into consideration, it was separated into two sections as the rights in terms of professional law and the rights in terms of disciplinary law. On the occasion of this thesis, it was intended to remind that health care professionals have rights. As a result of the nature of the relationship between them, while trying to protect the rights of patients who are in a weak position, it was intended to point out that if we do not show the necessary sensitivity to the rights of the health care professionals who are on the other side of the relationship, the professional satisfaction of the health care professionals could not be obtained. In such a case, patient rights can not be adequately protected and patient satisfaction can not be increased nor an ideal health policy can be implemented.
