Abstract
Hukuk Muhakemeleri Kanunu 1.10.2011 tarihinde yürürlüğe girmiştir. Türk mahkemelerinin milletlerarası yetkisine ilişkin Milletlerarası Özel Hukuk ve Usul Hukuku Hakkında Kanun md. 40, iç
hukukun yer itibariyle yetki kurallarına atıf yapmaktadır. Bir davada
HMK uyarınca yer itibariyle yetkili bir mahkeme mevcut değilse, Türk
mahkemelerinin o dava için milletlerarası yetkisi de yoktur. Bu çalışmada, HMK’nın yetkiye ilişkin hükümlerinin Türk mahkemelerinin
milletlerarası yetkisi bakımından doğuracağı sonuçlar incelenmiştir.
The Civil Procedure Law entered into force on October 1, 2011. Article 40 of the Private International and Procedural Law, which governs the international jurisdiction of the Turkish courts, refers to domestic jurisdiction rules. If there is no competent court for a case according to domestic jurisdiction rules, then the Turkish courts do not have international jurisdiction in that case. In this study, the consequences of the jurisdiction rules of the Civil Procedure Law on the international jurisdiction of Turkish courts are examined.
