Abstract
Kat Mülkiyeti Kanunu'na göre ister klasik kat mülkiyeti olsun ister toplu yapılarda kat mülkiyeti olsun kat malikleri dilerlerse anataşınmazın yönetimini yöneticiye veya yönetim kuruluna devredebilirler. Kat maliklerine karşı KMK 38 hükmü gereği vekil gibi sorumlu olan yöneticinin kanundan, yönetim planından veya sözleşmeden doğan borçlarını Türk Borçlar Kanunu'nun vekalet sözleşmesine ilişkin hükümleri arasında yer alan vekilin borçlarına uygun olarak ifa etmesi gerekir. Aksi halde yöneticinin kusurlu eylemiyle bağlantılı olarak bir zarar meydana gelmesi halinde yönetici söz konusu zararı gidermekle sorumlu olacağı gibi, kat malikleri yöneticinin görevden alınması yoluna da gidebilirler.
